I accept that the idea of Judicial officers becoming permanent and pensionable after normal retirement age, and subsequently applying for HMOCS membership, is an odd one. But there are many unusual things about the Judiciary!
Much depends on whether the Secretary of state accepts the Governor's advice that we should set a new deadline of 15 April 1992 for Judiciary officers. If he does, I think there would be little option but to accept Fuad's and Kempster's applications to join HMOCS, as these were made before that deadline. If he does not, and you stick to the March 1985 deadline, I imagine that it follows that the applications will be refused.
Incidentally, Paul Fifoot is wrong in saying that there will be no purpose in the two Judges being granted HMOCS status. It is true that they will both have retired before 1997, so that there will be no question of them getting any compensation. But if Sterling safeguards are eventually agreed, they would benefit from being members of HMOCS, because by buying back pensionable service by returning gratuities paid to them, they could acquire a fairly sizeable pension.
