Extension of service

The Governor may approve extensions of service beyond the normal retirement age up to a maximum of 5 years (excluding accrued leave). Notwithstanding the above, judicial officer may continue in office for as long

long as necessary to enable him to deliver judgement or to do any other thing in relation to proceedings that were commenced before his normal retirement age or before expiry of the current extension. The extended service will be considered pensionable service.

A judicial officer who has attained maximum pension status before reaching the normal retirement age may retire from the pensionable service and be immediately re-employed in the same rank on gratuity bearing agreement

agreement terms until the day before his normal retirement age. He may receive his commuted pension gratuity on retirement but his monthly pension will be suspended during his re-employment service. His re-employment service will not count for any additional benefits under the Pension Benefits (Judicial Officers) Ordinance and Regulations 1988.

(0) Subject to the provision of the Pension Benefits (Judicial Officers) Ordinance and Regulations 1988, pension benefits are paid as of right.
