It is proposed that the new pension arrangements should apply to all members of the Judiciary appointed after the date of their introduction. In addition, it is recommended that all serving members of the judiciary, whether on local or overseas terms and whether on pensionable or agreement terms, except on agreement following retirement and re-engagement, should be given an opportunity to transfer to service under the new arrangements although the enhanced pension factor of 1/340th would only apply, where appropriate, in respect of service after the date of introduction of the new pension scheme. In the event that it became necessary to retire any expatriate Judicial Officer to facilitate localisation this could be done under the Limited Compensation Scheme. In the case of Magistrates the adoption of this policy could lead
could lead to 40 or SO agreement officers converting to pensionable terms in order to enjoy the higher pension benefits. This would limit the flexibility provided by the agreement system. The net result could be that more expatriate Magistrates would stay longer and thus cause problems in relation to future planning. However, these problems could again be overcome by the use of the Limited Compensation Scheme.
