HONG KONG HOMCS ISSUES: JUDICIAL OFFICERS

In his minute of 15 July, the Private Secretary

recorded that the Secretary of State was inclined not to

allow an extension of the deadline (from March 1985 to April 1992) for judicial officers to apply to become members of HMOCS, because they would reap a windfall which they had not earned. However, the Secretary of State wished to know whether the Governor believed that this would cause a major

difficulty for him.

I have consulted the Governor. He thinks that it would be quite wrong to impose a retrospective cut-off date that did not give the judicial officers the opportunity to become HMOCS members. He finds very unattractive the prospect of members of the Hong Kong judiciary seeking judicial review on this issue. He has also commented that a retrospective

cut-off date would create considerable dissatisfaction amongst a group who are sensitive at the best of times, and
