TRANSFER TO PERMANENT ESTABLISHMENT AND APPLICATION FOR HMOCS MEMBERSHIP

1.

I attach a draft statement on behalf of the Secretary of State and would be grateful for your comments as soon as possible.

2. A couple of points:

i) Please could you fill in the blank in paragraph 4 as I do not know how officers in Hong Kong were advised of the Secretary of State's statement contained in FCO telegram 1195 of 7 August 1992.

ii) Do the arrangements set out in paragraph 5 apply to members of the Hong Kong Judiciary?

3. You may wish to know that we have received a letter from Mr Suttill, Deputy Registrar, Supreme Court asking us to bear in mind the need to allow officers sufficient time to transfer to pensionable terms in order to become members of HMOCS. We intend to reply to Mr Suttill that we are aware of officers' concerns on this point and will take them into account.

I am concerned that the draft statement should be clear and accurate, particularly where different arrangements will apply to officers and to members of the Judiciary. I would have no objection to your passing a copy of the draft statement to the Registrar, Supreme Court for his comment, although he should of course not give it any wider distribution.
