HONG KONG: HER MAJESTY'S OVERSEAS CIVIL SERVICE: OVER

RETIREMENT AGE APPLICANTS

Problem

1. Three members of the Judiciary in Hong Kong who are past normal retirement age have applied for membership of Her Majesty's Overseas Civil Service (HMOCS).

Recommendation

2.

To admit the three members of the Judiciary to HMOCS.

Background and Arqument

3.

Two Justices of Appeal (Messrs Fuad and Kempster) and one Presiding Officer, Labour Tribunal (Mr Gregory Chan) have applied for membership of HMOCS. They are all past the normal retirement age of 65 and 60 respectively for the purposes of the Pension Benefits (Judicial Officers) Ordinance and Article

XVIA (2)(a) of the Letters Patent. But their service has been

extended, as provided for in Article XVIA (2)(b)(ii) of the

Letters Patent.
