apply to become members of HMOCS before 30 June 1992 and are subsequently accepted as such members will be treated as falling within para. 3(b) above.

Judges in Hong Kong (i.e. judges of the Supreme Court and any court to which appeals lie from the Supreme Court and judges of the District Court) who:

(a)

(b)

satisfy the condition set out in paragraph 3(a) above and

either were accepted by or on behalf of the Secretary of State on or before 30 June 1992 as -members of HMOCS or Her Majesty's Overseas Judiciary (HMOJ), or were individually informed on or before 30 June 1992 by or on behalf of the Secretary of State that they would be treated in the same manner as a member of HMOCS,

other than judges referred to in paragraph 5 below, will also be eligible as entitled officers for benefits under and in accordance with the Scheme.

OFFICERS NOT ELIGIBLE FOR BENEFITS UNDER THE SCHEME

5.

The following categories of officers and judges are not eligible for benefits under the Scheme:

(i)

(ii)

(iii)

(iv)

officers and judges who would reach normal retirement age on or before 30 June 1997;

officers and judges on leave pending retirement on 30

June 1996;

officers seconded ot temporarily Kong;

transferred to Hong

officers who have received any benefit under the Compensation Scheme for Certain Pensionable Officers promulgated by the Government of Hong Kong and published

an Annex to Civil Service Branch Circular No. 24/87 of 9 December 1987, provided that any officer who has received such compensation in accordance with para. 2(a)

the annex to Civil Service Branch Circular 24/87 shall be eligible to receive the equivalent of the difference between the compensation already paid and that for which he would otherwise have been eligible under this Scheme.

CALCULATION FOR BENEFITS PAYABLE UNDER THE SCHEME

6.(1)

A

Calculation will be made of a notional sum for which each entitled officer would be eligible under the Scheme using the factors appropriate to the age and pensionable service of the officer in the relevant Table.
