DRAFT PROPOSALS FOR A SCHEME BY THE UNITED KINGDOM GOVERNMENT FOR MEMBERS OF MOCS IN HONG KONG (INCLUDING JUDGES ENTITLED TO BE TREATED IN THE SAME MANNER AS MEMBERS
AS MEMBERS OF HMOCS)
DATE OF INTRODUCTION OF THE SCHEME
1. The Scheme would come into operation on 30th June 1997.
DEFINITION OF "NORMAL RETIRING AGE"
2. In this Scheme, "normai retiring age" means:
(a) in the case of an entitled officer, other than a member of a disciplined service or a judge,:
(i) to whom the Hong Kong Pensions Ordinance (CAP 89) applies, 55;
(ii) to whom the Hong Kong Pension Benefits Ordinance (CAP 99) applies, 60;
(b) in the case of an entitled officer who is a member of a disciplined service:
(i) to whom the Hong Kong Pensions Ordinance applies, 55;
(ii) to whom the Hong Kong Pension Benefits Ordinance applies, 57;
(c) in the case of a judge of the Supreme. Court or of any court to which appeals
lie from the Supreme Court, 65;
(d) in the case of a judge of the
District Court appointed as such before 1st January 1987, 60;
(e) in the case of a judge of the District Court appointed as such on or after 1987, 65.
OFFICERS ELIGIBLE FOR BENEFITS UNDER THE SCHEME
3. Overseas officers who:
(a) are the substantive holders of a.. pensionable office in the service of the Hong Kong Government on 30th June. 1997 and
(b) became members of Her Majesty's Overseas Civil Service (HMOCS) on or- before 30th June 1992,
other than officers referred to in paragraph 6 below, will be eligible for benefits under and in accordance with the: Scheme (and are referred to as "entitled officers").
4. Judges in Hong Kong (1.e. judges of the Supreme Court and any court to which appeals lie from the Supreme Court and judges of the District Court) who:
