3. The other main changes to the statement reflect legal advice that we should do what we can to avoid judicial criticism on the
grounds of overly obscure presentation. The changes are therefore primarily aimed at making the proposals clearer. The
following paragraphs explain the revised text:
(a) Paragraph 1. This now also includes para 4 of the previous
draft.
(b) Paragraph 2. The reason for this paragraph is to put up
front in a clearer way why we are proceeding on the basis
that is described further in the statement. We have
deliberately not referred directly to the previous policy
papers and to 'historical'' precedent.
(c) Paragraph 3. This is intended to set our scheme in the Hong
Kong context and to provide more of a link with the HKG
compensation scheme.
(d) Paragraph 4 endeavours to set out more clearly exactly what
it is we are proposing. We have taken account of your view
that the first payment should be made under British
sovereignty.
(e) Paragraphs 5 and 6. Paragraph 5 picks up the points made in
paragraph 6 and 8 of the previous draft statement.
Paragraph 6 picks up the point made up in paragraph 7 of the
previous statement.
(f) We have omitted from the statement the previous proposal
that the sums of money would be set aside and would become
