Trinidad and Tobago (Constitution) (Retirement of Entitled Officers) Regulations, 1960

(2) Save as is otherwise provided in these Regulations, the appropriate law shall apply in relation to the grant of pensions and gratuities, and to pensions and gratuities granted, pursuant to these Regulations; and the provisions of these Regulations shall be construed as one with the provisions of such law:

Provided that where under the provisions of such law any authority or power is vested in the Governor or the Governor in Council such authority or power shall for the purposes of these Regulations be exercised by the Governor acting in his discretion.

(3) Expressions used in these Regulations shall, unless a contrary intention appears, have the meaning ascribed to such expressions in the appropriate law.

3. (1) If, on the application of an entitled officer made before he attains Retirement pensionable age, a Secretary of State is satisfied that, as a consequence of of entitled constitutional changes, the career of the officer in the public service of the Government of Trinidad and Tobago has been adversely affected or there are reasonable grounds for believing that the officer's career in the public service of the Government of Trinidad and Tobago will be adversely affected, a Secretary of State may permit the officer to retire forthwith or on such date as may be specified by a Secretary of State and the officer shall be entitled to retire accordingly.

(2) If an entitled officer, not being domiciled in any territory of the Federation of The West Indies, applies before he attains pensionable age for permission to retire for the purpose of facilitating the appointment or promotion in the public service of the Government of Trinidad and Tobago of a person domiciled in a territory of the Federation of The West Indies, the Government of Trinidad and Tobago may, with the approval of a Secretary of State, permit the officer to retire forthwith or on such date as may be specified by the Govern- ment of Trinidad and Tobago, and the officer shall be entitled to retire accordingly.

(3) The decision of a Secretary of State as to whether or not, as a consequence of constitutional changes, the career of an entitled officer has been adversely affected or there are reasonable grounds for believing that an entitled officer's career will be adversely affected shall be final.

4. (1) An entitled officer shall upon retirement be granted a pension under Award of the appropriate law as modified by these Regulations.

(2) Such entitled officer shall be granted such pension notwithstanding

that_

(a) he has not attained an age specified in the appropriate law to be

necessary to qualify him for the grant of a pension;

(b) he has not been in qualifying service for such period as is required by the appropriate law to render him eligible for the grant of a pension;

(c) being an officer on probation he has not been confirmed in a

pensionable office.
