Gratuity where an officer dies.

(3) A gratuity payable under the provisions of this Regulation shall not exceed the gratuity to which the officer, if he had retired, would have been entitled under the provisions of sub-paragraph (b) of para- graph (3) of Regulation 4 of these Regulations.
6. (1) where an entitled officer dies-

(a) after he has been granted permission to retire but before either retiring or taking up an appointment in lieu of retiring; or after making application to retire but before being granted per- mission to retire and the Secretary-of-State or the-Government of Jamaica withthe-approval-of-the Secretary of-State, as the case may be, would have if he had not died granted him permission to retire, there may be paid to the legal personal representative of such officer or
(femer.) such of his dependents as the Governor may think fit either-

Free passage.
(i) the gratuity in accordance with the provisions of the First Schedule to these Regulations to which the officer would have been entitled if he had retired on the day of his death; or (ii) a gratuity calculated in accordance with the provisions of section 16 of the Pensions Law of Jamaica favhichever is the greater.
(2) Any award made pursuant to this Regulation shall be in licu of any other award that could have been made pursuant to the appro- priate law.
7. Where an entitled officer was recruited from a territory outside Jamaica and either was not born in Jamaica or is not domiciled in Jamaica he may, on retirement, whether or not he has completed such period of service as is required by the General Orders of the Government of Jamaica to qualify him for the grant of free passages, be granted free passages from Jamaica to the territory of his recruitment on the basis set out in such General Orders.

FIRST SCHEDULE
Gratuity payABLE UNDER Regulation 4
1. The gratuity payable to an entitled officer under Regulation 4 of these Regulations shall be calculated by multiplying the amount of the officer's annual pensionable emol- uments by a factor-
(a) in the case of a Judge of the Supreme Court, to be ascertained from Table A of this Schedule appropriate to the officer's age at the date of his retirement; and
(b) in the case of an officer other than a Judge, to be ascertained from Table B of this Schedule appropriate to the length of the officer's pensionable service and his age at the date of his retirement; service in excess of ten shall be the same as the appropriate factor specified and the factor for years of pensionable for ten years:
Provided that where either the age or the length of service of an officer at the date of his retirement is more than an exact number of years his gratuity shall be calculated having regard to the completed months of service and age in excess of the figures appro- priate to the officer in the table and there shall be applied a factor proportionally in- creased or decreased accordingly.

2. In pacate shall a gratuity payeble under these Regulations exceed £8,000.
