1. Thank you for your recent advice on aspects of this problem: the nature of HMG's obligations to HMOCS officers; the scope for judicial review of the decisions we take; and the possibility of our legislating to overcome LegCo's control of use of Hong Kong revenue on HMOCs pensions.
2. After several rounds of discussion with ODA and the
Treasury, and separate contacts with HKG, we have produced the attached draft interdepartmental paper on the subject. I should be grateful if you could consider this and let me know if you have any comments. It is possible that the Secretary of State may wish to send a version of it to colleagues at the beginning of February, so comments next week would be helpful. Could you please telephone me forewørn me if you see any major problems in the draft.
