MODALITIES OF RETURN OF THE DOUBLE-BACKERS AND THEIR ACCOMPANYING, FAMILY MEMBERS:

Building on previous understandings and experiences with repatriation to Vietnam, the following measures were agreed.

The United Kingdom/Hong Kong Governments will hand over to the Vietnamese Government lists of double-backers and their accompanying family members identified after arrival in Hong Kong, and containing similar background information to "that in the lists given to the Vietnamese Government in cases of application for voluntary return. Following receipt of these lists the Vietnamese Government will authorise the return of the double-backers and their accompanying family members..

The United Kingdom/Hong Kong Governments will give the Vietnamese Government 14 days notice of the date, place and flight details planned for the return and hand over a list of those scheduled to return on the flight in question. The Vietnamese Government will indicate what if any additional documentation for returnees, flight crew or escorts it requires.

The United Kingdom/Hong Kong Governments will seek the necessary diplomatic clearance for the flight and the Vietnamese Government, will inform the United Kingdom/ Hong Kong Governments of its authorisation for the flight at least seven days before the planned flight date.

The United Kingdom/Hong Kong Governments will give the Vietnamese Government final confirmation of those scheduled to return 72 hours before the flight date. The Vietnamese Government will accept at this stage any deletions and consider any additions to the list, previously submitted at (b), based on lists originally submitted at (a) above.

The United Kingdom/Hong Kong Governments will provide the Vietnamese Government with a definitive list of those who return at the airport on arrival.

The United Kingdom/Hong Kong Governments will provide the Vietnamese Government with health certificates in respect of those who return at the airport on arrival.

Returnees in this category will enjoy the same guarantees as foreseen in the Memorandum of Understanding of 13 December 1988 between the Socialist Republic of Vietnam and UNHCR.'
