In law Razaleigh was the minister responsible for clearing the currency

from HK to Malaysia via the Central Bank, Bank Negara which is part of

the Ministry of Finance. He was responsible for examining and

authorising the lending to Carrian.

The HK Prosecutor in control of every aspect of the case, subsequent

upon the agreement between the Attorney Generals and the United

Kingdom, was one Warwick Reid who is referred to in EXHIBIT 1. He is

now in jail, serving 8 years for corruption. Members of his department

also face indictments for corruption and numerous other charges. Reid, in

accordance with agreements reached, collected and selected biased and

incomplete evidence.

The Crown's principle witness, Ibrahim Jaafar, was the general manager

of BMFL. He was also Razaleighs personal representative in HK,

controlling a substantial amount of Razaleigh's funds, and investing them

through a complex web of nominee and offshore companies. He was

granted criminal immunity by the jailed prosecutor Warwick Reid and

civil immunity by BBMB.

A BMFL official, Jalil Ibrahim, was murdered 11 days after he wrote to

Razaleigh requesting confirmation of his ownership of a number of

Carrian shares. It appears that these shares were given to Razaleigh by

George Tan. Mak Foon Than who was convicted of the murder claimed

that Razaleigh had sent him to HK. He later withdrew this accusation but

allegedly only after threats were made against his family.
