much on the contents of the board papers and, as such, it is relevant to have

the board papers fully to understand. Each board paper is numbered in

Of those, 84 board papers are missing, although 10 of such papers are not

referred to in "CHA 1 and were not therefore inspected in 1986.

Of the 74 board papers listed at "CHA 1", but missing, 56 of them are in

respect of 2 board meetings, 15th September 1981 and 15th December 1982. I

produce the agenda for these 2 meetings (Pages 48 60 "LEO 1") from which it

will be noted that the missing board papers are in respect of loans/deposit

position, foreign exchange business, money market operations, offshore loans

and foreign currency loans, reports from the foreign branch offices, the loan

applications considered by the Board (including, importantly, as I hav

explained above, the loan applications attached to them), and review

outstanding loans. The significance of the missing board papers is that the

yould demonstrate a fundamental part of my case, that the Board were full

Cavare of the Carrian loans. Mr. Allison himself considered board papers

such nature to be material and produced similar board paper as part of "Cl

3". The Board members had full knowledge of the financial positions of t

overseas branches which funded a significant proportion of the Carrian loan

Mr. Allison also produced document serial No. 578, board paper No. 1058 (i)

the foreign exchange business. Board papers concerning BBMB's offshore loa

and foreign currency loans are similarly relevant (see board paper no. 9

serial No. 384 on CHA 1 and exhibit at CHA 3). Board papers concerning BBM

money market operations are clearly relevant but are missing from the bo

papers for the board meetings on 23rd January 1979 ("HA 1", serial No. 63),
