OSMAN: NOTE OF A CONFERENCE HELD WITH JOHN LAWS,

1. This conference was arranged to discuss Hong Kong's concern about four documents which were not listed in the schedules to either of the PII certificates issued in respect of Osman's fourth application for habeas corpus. The Hong Kong Attorney General is apparently of the view that the existence of these four documents should be disclosed to Osman's solicitors.

2. Mr Laws gave his opinion in robust terms. He said that in preparing for the fourth habeas corpus application a bona fide view had been reached that these documents were not discoverable. There was not the slightest reason now to second guess that view. If the existence of these documents was nevertheless disclosed to Osman's solicitors it would be

an act done under cover of no perceptible legal duty whatever. He suggested that a note from the Attorney General or Solicitor General to the Hong Kong Attorney General might be the best way forward.
