General's Chambers wrote to Tan's representatives advising them
that the Hong Kong government now intended to proceed with the

On 13th November 1990, an application was made by Tan
Judge Cameron of the District Court seeking to stay the
West LB/Barclays Asia charges.
26. On 4th December 1990, Judge Cameron gave his decision not to
stay those proceedings and gave his judgment on 18th December
1990. Tan applied to judicially review the Court's decision.
His application was dismissed by Barnett J. on 13th May 1991 and
his appeal to the Court of Appeal is now pending. The
WestLB/Barclays Asia trial is presently fixed to commence on 20th
January 1992.

On 4th December 1990, the Hong Kong government applied
to Magistrate Sinclair and, over Tan's objection, was granted a
six-month adjournment of the BMFL trial. Leading Counsel for the
Hong Kong Government made the following submissions to the Court:
