correspondence from early 1989 with BBMB who had got the

documents, which culminated in a visit by Osman's solicitor

to the premises of BBMB on 10 September, 1990, when he was

told that without a court order BBMB would produce only

those documents upon which the Government had relied during

It ordered the production for inspection of the 5439

documents and files. BBMB applied to set aside the order,

but their application was dismissed and inspection

commenced on 15 October. Of the 5439 documents and files

listed by Mr. Allison 3480 were missing. A member of the

secretary's office of BBMB (Cik Zanyah Wan Chik) apparently

said that the missing documents "are presently

untraceable".

On 19 October BBMB wrote that it was "trying

its utmost" to trace the "missing and misplaced documents".

At the conclusion of the hearing before us no more had been

heard from BBMB.

Osman does not, of necessity, know what is in the 3480

documents and files. However, from their description in

Mr. Allison's list (contained in "Ak/1") many of them may

be relevant to Osman's defence. The untraced documents are

discussed in Osman's affirmation of 29 October, 1990 para.
