guidelines we are using and as you know, only criteria A, B and C call for incorporation in the UK or Hong Kong whereas criteria D covers companies incorporated else- where.
5. I believe our response should be that service with an approved undertaking in places other than Hong Kong does qualify for additional points, but that a Hong Kong presence is required since this is what is clearly called for in our guidelines. Such a course will not result in additional work for the Committee in fact just the opposite since the onus will be on HKID to ascertain if an applicant worked overseas for an approved under- taking and they will be able to dismiss companies with no Hong Kong presence without reference to the Committee.
In view of the fact that these questions have been raised by Immigration Department's/Adviser, we would Lesse welcome your views (and those of our Legal Advisers) before replying.
