BRITISH NATIONALITY (HONG KONG) ACT 1990: LIST OF BRITISH UNDERTAKINGS

Thank you for your minute of 23 January on the above in which the Minister has further commented on the fact that perceptions are a questionable basis for deciding "Britishness".

In view of the Minister's doubts, shared by FCO Legal Advisers, the Advisory Committee has received advice that cases falling under paras 2(c) and 2(d) of our original submission of 17 December should be judged for their "Britishness" by compliance with the criteria rather than by how they may be "perceived".
