1. Anthony Scrivener QC, Chairman of the Bar Council has

written to the Secretary of State about the case for

barristers in Hong Kong to be considered within the

Nationality Scheme.

Recommendation

I recommend that PS/Lord Caithness reply on the lines of

the attached draft. Legal Advisers are content.

Mr Scrivener's point about Hong Kong barristers not

being included in the Scheme is not correct. All barristers will be entitled to apply. What Mr Scrivener is referring

to is the extra points available for employment with a British undertaking. Some solicitors will qualify for

these points but no barristers are able to qualify.
