We are most grateful to hear that the Hong Kong Government accepts that the issues raised merit serious consideration. We regret however that your letter does not offer anything other than an expression that barristers will be catered for in some unspecified way and the Hong Kong Bar Association finds that highly unsatisfactory.

Whilst we do not doubt the intention of your Government to include barristers amongst the persons considered to be essential to the well being of Hong Kong, it appears that a concrete solution to redress the discriminatory effect on practising barristers has yet to be found. The points system as embodied in the British Nationality (Hong Kong) (Selection Scheme) Order 1990 made by Her Majesty was devised to provide an objective criterion for an equitable allocation of British Nationality to members of certain sectors of the society. As it presently stands, the Scheme favours solicitors but at the expense of the practising Bar thereby defeating the object of the Scheme.

Merely referring our concern, to the Governor's Steering Committee with a view "to ensuring that barristers will be adequately catered for" does not in any way relieve the anxiety and sense of grievance felt by our members as a result of the unjust treatment of them albeit the effect was unintended.

Under section 17B of the Scheme, a maximum of 35 points will be given to any
