The matter is not as straightforward as you may have thought and B4 are not yet able to give us advice. I have stressed the need for an early response, given the Governor's wish to have as many things as possible tied up before his forthcoming visit. It may be necessary for us to go to Ministers.

Moving to the vexed question of the computer system, I am sorry if the terms of my letter to Judy of 8 January are causing you administrative difficulties. I have confirmed that if the Home Office is to procure the system and sign the contract it must retain ownership. In any case, leaving aside convenience for a moment, this must, in principle, be right. If HKG are obliged to insist on formal ownership to satisfy the requirements of their financial regulations, then I am afraid HKG will have to negotiate the contract and sign. With the best will in

in the world, this will mean severe slippage in the timetable inevitably beyond the projected point at which recommendations are likely to be coming at full stretch from the Governor and it would not be possible for the UK team to issue certificates at those levels using the contingency arrangements which have been sketched out.

This whole exercise is, for us as much as for you, uncharted territory and we are having to make adjustments to normal procedures as we go along. At some points, corners have to be cut in the interests of getting the system up and running as quickly as we can.
