a result of you advertisement in the "Allgemeine Hotel- und Gaststättenzeitung" of 24.11.90 I got to know that you are offering jobs abroad to German workers. As a precaution I must point out the following to you:

In the Federal Republic of Germany every activity which directed towards bringing together, for the purposes of an employment relationship, employers and those seeking employment, in accordance with § 13, paragraph 1 of the Employment Promotion Law (AFG), extracts from which are enclosed, represents placement, which in accordance with § 4 of. the AFG can only be undertaken by (the administrative offices of) the Federal Institute for Labour (BA) and those establishments and persons authorised to carry out placement under @ 23 of the AFG.
In accordance with @ 13. paragraph 2. 1st sentence of the AFG, placement also includes the issue and circulation as well as the display of lists of vacancies and situations required.
The Federal Institute for Labour, in accordance with @ 18, paragraph 1, of the AFG, also undertakes placement and recruitment in the Federal Republic of Germany for employment abroad, as well as placement and recruitment abroad for employment in the Federal Republic of Germany. Establishments and persons outside the Federal Institute for Labour who do not have a special contract for placement abroad require in each individual case my prior approval. This also applies to professional placement agents and personnel advisers. It is not proposed to give such approval to establishment abroad.
