☐ What are the rules for employing an
overseas national already in the United Kingdom but not in approved employment?
25 There are special rules for students requesting
part-time or holiday employment (see paragraph 28 of leaflet OW5). Otherwise the general rules and procedures are the same as those for overseas nationals living abroad. The main difference is that the Department cannot consider your application until the Home Office has decided whether the conditions attached to the overseas national's stay in the UK can be changed. (The overseas national should not have commenced employment with you because that would breach those conditions).
How is an extension of stay in the United Kingdom applied for?
26 An application in writing has to be made 2-3
months before the work permit expires to the Home Office at the address given in paragraph 30. You can apply or the overseas national can do it. There is no official application form for this purpose. The Home Office will need the overseas national's:
passport;
police certificate of registration or, for a Commonwealth citizen, either the work permit or this Department's letter of approval;
a letter from you, the employer, stating:
■how long you wish to keep the overseas national in the job for which you have our permission;
details of any examinations taken.
■ Students of agriculture or horticulture
27 There are separate arrangements for overseas
nationals who wish to come to this country for a limited period with employers in agriculture or horticulture to further their studies. Enquiries should be made to:
