Thank you for your letter of 21 October and the enclosed exchange of telegrams between your department and the Hong Kong Government.
You will have received a faxed copy of our Legal Adviser's comments of 25 October 1991.
3. We are pleased to note the Hong Kong Government does not consider that our
undertaking revenue earning activities would breach the conditions of the grant of land for the proposed Consulate-General.
4. In view of the Hong Kong Government and Tony Galsworthy's adivce that the
Council should establish for itself a firm legal identity prior to 1997 the Council as a body corporate, would wish to register as soon as possible, as an overseas company under Part X1 of the Hong Kong Companies Ordinance (CAP 32).
5. Clearly there is a risk, which equally clearly at this distance it is
impossible to guage, that post 1997 the Chinese might take the view that no revenue earning activity, such as English teaching, could take place on the Consulate-General site. In view of this any agreement the Council reached with Overseas Estates Department, FCO over its part occupation of the Consulate-General would need to take this into account and allow for early vacation of part or all of the premises.
