Article 144
Exceptional Treatment
In this class of trials, bail shall not be permitted nor shall appeals of habeas corpus or protection of freedom be accepted in the
proceedings; nor shall there be conditional sentences, early release or parole, nor remission or reduction of penalties, nor the benefits of the Law of Pardon or of amnesty.
Article 145
Value as Evidence of Action before the Trial
The information report by the Public Force and the pre-trial statement by the defendant in the presence of the prosecuting officer shall constitute a serious presumption of guilt if the corpus delicti is found to be justified.
Article 146
Chemical Analysis of Substances Held
The substances held are to be subjected to chemical analysis; to that end, samples are to be taken and delivered by the Executive Secretariat to the experts specified by the President of the Court; these are to submit their report within the period given by the President.
In the appointing of such experts, preference is to be given to professional persons who serve in the laboratories of CONSEP or the "Leopoldo Izquieta Pérez" Institute of Hygiene.
The outcome of the chemical examination or analysis is to constitute full evidence as to the existence of the offence.
Article 147
Mutual Judicial Assistance
The Criminal Court may request assistance from the like or police bodies abroad in the conduct of case inquiries and the investigation of the offences specified in this Law,
This assistance is to relate, inter alia to the detention and transfer of persons accused, the taking of testimony, production of documents (including bank documents), inspection of premises, sending of evidence, identification and analysis of controlled substances and the seizure of assets. Such proceedings are to be attached to the case as lawfully conducted and assessed by the Court in accordance with the rules of sound judgement.
Requests for mutual assistance are to be made through the diplomatic channel or through Interpol.
Article 148 Precautionary Measures
In the writ to initiate a case, orders are to be made for those personal and real precautionary measures provided in Article 171 of the Code of Criminal Proceedings which are relevant and, in particular, for a prohibition on disposal of any property of the accused and freezing of his cash, current and savings accounts, and company holdings and shares.
