Mutual Assistance in relation to Drug Trafficking

In 1989 Hong Kong enacted the Drug Traffic- king (Recovery of Proceeds) Ordinance, which follows closely the UK Drug Trafficking Offences Act 1986, and provides for the tracing, confiscation and recovery of the proceeds of drug trafficking. Section 28 of the Ordinance provides for inter- jurisdictional co-operation in this area by way of the designation of

of other countries and territories so that the Ordinance may apply to their confiscation orders and related proceedings.

We understand that Gibraltar has similar legislation, and that arrangements have been con- cluded between Gibraltar and the United Kingdom for mutual assistance in the restraint and confiscation of the proceeds of drug trafficking through desig- nation of each other under their respective anti drug trafficking legislation. Hong Kong also has established such an arrangement with the United Kingdom.

We believe it would be valuable to establish such arrangements with other Dependent Territories with compatible legislation, and propose this be achieved by an exchange of letters
