Further to Geoff Woodhead's letter of 19 April 1991, I thought it would be useful if I were to write briefly to let you know we had a productive first round of discussions with the Malaysians in Hong Kong from 6 to 9 May.

Essentially the Malaysians are content with our draft model agreement, though they have difficulties, as you would imagine, with the death penalty safeguard provisions under Article 4. The Malaysians tabled a revised draft of Article 4 which I enclose for your reference. I indicated that their formulation was probably unacceptable and asked that they consider the optional death penalty discretion clause to the Commonwealth Scheme.

We agreed provisionally to meet again in September or October this year. In the interim we shall consider how best we can address the problems arising in respect of Article 4 and will seek your views and Executive Council's advice in due course.
