PROPOSED HONG KONG/CANADA EXTRADITION AGREEMENT: INSTRUMENT

OF ENTRUSTMENT

Problem

1. Hong Kong want to negotiate and conclude a bilateral

extradition agreement with the Canadian Government. In order to proceed, the Governor of Hong Kong requires an

entrustment from the Secretary of State, adding Canada to the list of countries with whom Hong Kong is authorised to negotiate on extradition.

Recommendation

2. I recommend that the Secretary of State send a despatch to the Governor constituting the necessary authority. I

submit a draft. Legal Advisers are content.

Ministers approved my submission of 26 November 1990

about Hong Kong's future extradition arrangements. In

summary, Hong Kong's current extradition arrangements are

governed by extension of the UK's agreements, which will lapse in respect of Hong Kong in 1997. In order that Hong
