1. There are three aspects of the recently initallied Hong Kong/Netherlands Extradition Agreement which require action:

(a) We need to be sure that we are content with the details of the initialled draft agreement (Hong Kong telno 1297 and draft agreement copied to you). I should be grateful for your views.

(b) The Netherlands Government have proposed an exchange of diplomatic notes to the effect that all future communications under the existing treaty be through the Consulate-General of the Netherlands in Hong Kong (Hong Kong telno 1298). The Netherlands Embassy have now passed us a draft note for comments (attached). It differs slightly from the text in Hong Kong telno 1298: points of significance seem to me the date on which the European Convention on Extradition entered into force between the UK and Netherlands (14 or 16 May?); and the reference in Hong Kong's draft to "until [the 1898 Treaty] has been replaced

by a new agreement as envisaged". I should be grateful for

your comments on the note sent by the Netherlands Embassy as as possible so that we can give them a substantive

reply.

My minute

(c) We need to look again at disapplication of the existing extradition arrangements to coincide with the coming into effect of Hong Kong's new agreement. to you of 9 April (attached) refers. Perhaps we should now draft the exchange of notes.
