The surrender of a fugitive offender may also be refused if the requested Party considers that:
(a)

the offence is, having regard to all the circumstances, not sufficiently serious to warrant the surrender; Or
Liece nas been excessive delay, for reasons which cannot be imputed to the fugitive offender, in bringing charges against him, in bringing his case to trial or in making him serve his sentence or Chic immainder thereot; or

Lne circumstances of the case, the surrender of the fugitive offender would be incompatible with humanitarian considerations in view of age, health or other personal circumstances.
