Petition to H.D. the Governor

from CHAN Kan-sau (Prisoner No. 15189)

The petitioner CHAN Kan-sau is 36 years old and at the time of his arrest lived at wooden hut, No. 94, Heung Fan Liu, Tai Wai, Shatin, New Territories. On 16th November 1979 he was convicted of Murder and sentenced to death. The petitioner's appeal against conviction was dismissed on 23rd June 1980. The Governor in Council commuted the sentence to life imprisonment on 4th May, 1981.

Summary of Evidence

About 2314 hours on 9th December 1970 the petitioner was a member of a group of five men who attacked and fatally stabbed a man with knives in the New Paris Sze Chuen Restaurant, Mezzanine floor, 37 Kimberley Road Tsim Sha Tsui, Kowloon. The deceased was a known illegal gambling casino operator, as were his attackers who were all memoers of the Kung Lok Triad Society. The attack was due to the victim failing to pay a gambling debt. Immediately after the stabbing the culprits ran away. The petitioner was arrested by police acting on information in Tui 0, Lantau on 24th February 1979. Later at an identification parade the petitioner was positively identi- fied by five witnesses as having participatea in the stabbing.

Petitioner's Grounds

The petitioner claims that he was a friend of the victim, and although he was at the scene he had only tried to reconcile the victim and another culprit who had started fighting after an argument. He claims that ne had no prior knowledge of a gambling debt and requests a date for his release from prison. When formally charged with murder the petitioner stated that he was going to assist in the collection of a debt.

Conclusion

The petitioner was trieu and found guilty of murder with three other culprits, all of them operators of illegal gambling casinos. The petition is without merit.
