Introduction

This petition is presented on behalf of the prisoner by his He is a 35 year old Hong Kong belonger. He has previous convictions for Defilement of a girl, Robbery, Membership of triad society and Unlawful possession. an 16.11.79 he was sentenced to death for Murder. An appeal against sentence was dismissed. HE the Governor commuted the death sentence to Life imprisonment on 5.5.81.
Brief facts of case

At about 2314 hours on 9.12.78 the petitioner was a member of a group of five men who attacked and fatally stabbed a man with knives in the New Paris Sze Chuen Restaurant, Mezzanine floor, 37 Kimberley Road, Tsim Sha Tsui, Kowloon. The deceased was a known illegal gambling casino operator, as were his attackers who were all members of the Kung Lok Triad Society. The attack was due to the victim failing to pay a gambling debt. Immediately after the
stabbing the culprits ran away. The petitioner was arrested by Police acting on information in Tai 0, Lantau on 24.2.79. Later at an identification parade the petitioner was positively identified by five witnesses as having participated in the stabbing.

The mother of the prisoner states that her son has been imprisoned for a period of 10 years and that she and her husband are now quite elderly and would like to see their son released in order that they may be cared for. They therefore request that HE the Governor remit the sentence to a definite term of imprisonment.
