PETITIONS TO HER MAJESTY THE QUEEN: MR CHAN CHUN-SHAN

1. We discussed these two cases just now. In both the cases of Mr Kan San Chan and Mr Kan-Cheung Chan, I see nothing in the papers supporting the petitions which would justify releasing the prisoners from prison as their father, Mr Chun-Shan Chan, requests. They were both Triad members at the time of the offence they committed, participating in a brutal murder. They both have a history of convictions for serious offences. The appeals both men made against conviction and sentence were refused. The Attorney General of Hong Kong sees no legal grounds in either petition which would justify release from imprisonment. Nor do the Notes by Attorney General's Chambers on the two cases provide any legal grounds. Finally, the petitions are unsupported by the Probation Officer, the Commissioner of Police and the Commissioner of Correctional Services. In my view both petitions should be refused. However, neither petition is minor, trivial or perverse. The normal procedure for petitions to the Queen should therefore be followed in these cases (see Annex 9.1, DSP 4, Part I).
