I have received from the Hong Kong Government two attached petitions to the Queen. They are made by Mr Chan' Chun-Shan (and his family) on behalf of two of his sons, Mr Chan Kan-Sau and Mr Chan Kan-Cheung. The Hong Kong Government has advised that the petitions be denied.

The Chan brothers are both Triad Society members and were involved in brutal murder of a man in a restaurant in December 1978. They had been collecting debts with their Triad leader. The brothers were found guilty of murder and sentenced to death in November 1979. The sentences were committed to life imprisonment early in 1981. These petitions are the fourth and third by or on behalf of Chan Kan-Sau and Chan Kan Cheung respectively.

These cases seem fairly straightforward. Despite the evidence that the prisoners are penitent and making efforts to change their ways, there is nothing to justify a special consideration of these cases. The Attorney General has advised that the petitions raise no legal grounds which may justify the prisoners' release. The Board of Review, Long Term Prison Sentences last reviewed the cases in January 1990; and will do so again in December his year. I therefore recommend that we forward these petitions to the Balace in accordance with
DSP Vol 4 (1990) Chapters 9.5.4/9.5.5, with the advice that they
be denied.

Mr Chan, Kan Sau
A1 i) Petition to the Queen from the prisoner's father, Mr Chan Chun Shan and family, on the prisoner's behalf.
B1 ii) The comments of the Attorney General on this petition; Comments made by the Attorney General on the (third) petition made by Chan's mother in 1988.
iii) A social enquiry report on the prisoner investigating his family circumstances.
