Hong Kong:Australia ASA – differences

recently "note

1 promised to let you have a commentary on the initialled Hong Kong:Australia ASA and a draft of differences" which, subject to your agreement, UKRep JLG could hand

the Chinese side when they pass over the initialled text. What follows is, therefore, a comparison between the Hong Kong: Australia text and the Hong Kong model text dated 24 July 1989.

The main differences are:-

Designation and Authorisation.

Paras 3 and 4 have been re-numbered and para 4(a) contains a "principle place of business" formulation for the Australian side (c.f. HK: New Zealand ASA).

Revocation or Suspension of Operating

Authorisation.

"The principle place of business" formula is carried forward into para 1(a)(i) (c.f. New Zealand)

Principles Governing Operation of Agreed Services.

Para 4 was added at Australian behest to signal that an imbalance in capacity was not ruled out. However, since the division of the spoils must be "mutually determined" there 19 no difference of substance.
