"125.
All other vessels [i.e. other
than those which belong to or are in the
services of the Government of the Territory]
registered as belonging to Her Majesty's
subjects in Her Majesty's Territories shall
fly the red ensign without any badge unless
otherwise authorised by warrant from Her
Majesty or from the Admiralty. Dependent
Territory merchant vessels may carry
distinguishing flags with the badge of the
Territory thereon, in addition to the red
ensign, provided that such flags do not
infringe Section 73(2) of the Merchant
Shipping Act, 1894."
Section 73(2) of the MSA 1894 provides that a British
ship may not fly a flag which resembles either other
national flags or Her Majesty's flags without a warrant
from Her Majesty or from the Admiralty.
8.3.
The effect of these regulations is that a British ship on the present Hong Kong Register must fly an undefaced Red Ensign and may, in addition, carry
other distinguishing flags incorporating the "badge of
the Territory" provided these latter flags do not look like any State's national flag or Her Majesty's flags.
