HONG KONG: IRO SUB-GROUP: PRIVATE INTERNATIONAL LAW TREATIES

I apologise for the delay in answering your request regarding the

papers on Trusts and Arbitrations.

As I told you on the telephone, this department is happy with the

Trust Convention paper and has no comment to make on it other

than it is clearly desirable that the Convention should continue

to apply to Hong Kong after 1997.

I encountered some difficulty in getting comments from DTI who

have responsibility for the Arbitration Convention but have now

spoken to Roger Fayers there who has told me that he has no

comments to make on that paper. He pointed out that while it is

desirable that all three Conventions should continue after 1997,

the most important of them is the New York Convention which has

been implemented by Ordinance in Hong Kong. It should certainly continue to apply after 1997 if Hong Kong is to remain a major arbitration centre.
