The conditions under which a foreign scaman engaged in a country other than his own has the right to be repatriated shall be as provided by national law or, in the absence of such legal provisions, in the articles of agreement, The provisions

of the preceding paragraphs shall, however, apply to a seaman engaged in a port of his own country.
The standard clauses and terms of service attached the Articles of Agreement for Hong Kong seamen employed on registered in Hong Kong provide that if the ship is not at le Kong on expiry of the engagement period, the seaman shall continue his service on board until the vessel's arrival at t first port where repatriation is practicable. It also provid that a seaman discharged at a port abroad for any reason shal be accommodated ashore when necessary and where it is not int that he should rejoin his ship, shall be repatriated vis sea air or otherwise as may be directed by the ship's master and, his accredited agent, to Hong Kong. Under the Articles of Agreement, the charge of repatriation in the shove circumst v shall be borne by the employer of the ceann.
