INTERNATIONAL CONVENTION FOR THE REGULATION OF WHALING (1945) AND ITS PROTOCOL: APPLICATION TO HONG KONG
1. Please refer to Miss Major's minute to you of 20 May.
2. Our 1984 files show that Treaty Section raised this question with MAED then. MAED asked the Secretariat of the IWC which confirmed that there had been no particular provision in the 1946 Convention for our Dependent Territories but customary practice within the IWC had been to treat them as covered. The IWC quoted the Bahamas as an example: apparently action had been taken there under the Convention to control pirate whaling vessels. Unfortunately, our 1985 whaling file and the later minuting are missing from LRD and so I am unable to advise on the outcome of Treaty Section's investigation, nor can I shed any light on the Bahamas case. Perhaps NTCD have papers?
3. I shall be attending the IWC Annual Meeting in Reykjavik next week and shall raise this question again with the IWC Secretariat, without singling out Hong Kong.
