I was surprised not to see in the draft submission the tactical argument employed by Mrs Barrett in para 5 of her minute of 19 August. The argument that the proposed arrangement could undermine other carefully constructed proposals for mutual legal assistance seems a strong one, and should be tackled in the submission.
