The BBC have indicated that in the early stages of their WSTV service they might not have sufficient material to fill each hour and might need to show an increased number of fillers which would be defined as station or programme promotion. They wish, therefore, that the Broadcasting Authority should have the right to permit an increase in this type of material. We have no objections to this proposal since the Authority would be under no obligation to approve any such request if made, but would simply have the discretion to do so if it saw fit.

The BA were consulted on HV's WSR proposals on 15 August 1991 and 12 September 1991. The Authority supported the transmission of WSR and had no objection to being given the discretion to permit an increase in station or programme promotion.
The Licence Amendments (Annex A)

Currently, the "Authority" for the regulation of all aspects of the HV licence is the Telecommunications Authority (TA) who, in regulating the programming aspects, acts after consultation with the BA. The Administration will shortly propose that the licence and the Broadcasting Authority Ordinance (Chapter 391) be amended to vest in the BA the power to regulate directly the programming aspects of the licensee's service. Until this is done, the TA will remain as the statutory Authority for the licence, consulting the BA where necessary, and the proposed licence amendments at Annex A reflect this arrangement.

The amendment to Condition 2 of the Licence provides for radio channels to be regarded as part of the "Service" for which HV is licensed.

New Conditions 4.4 and 4.5 limit the radio channels carried to those contained in new Schedule 4 and such other channels as may be carried under the terms of licence, and requires the licensee to seek the approval of the Authority before adding any new radio channels to its service.

New Condition 4.6 allows, subject to the approval of the Authority, radio channels to carry programmes in Cantonese.
