Thank you for your letter dated 1 October 1990 which was in response to my letter of 9 July 1990 and subsequent to my Deputy Secretary's meeting with Mrs

Mrs Elizabeth Smith on 18 September 1990.

I would now like to conclude our exchange of letters to provide, as simply as possible, for the 24 hours relay of the BBC World Service in English. I propose the following agreement which is, of course, subject to the approval of the Secretary of State.

1.

For the period of this agreement, namely beginning (for convenience) on 1 January 1991 or the date of the Secretary of State's approval, whichever is the later, and continuing thereafter until determined by either party giving to the other two calendar years'

years' written notice of termination, which notice may not be given to expire before 31 December 1999, the British Broadcasting Corporation ("the BBC") will -

(1)

provide to the premises of RTHK (which throughout this agreement includes its statutory successor which we expect to be called RTHK Corporation) at 30 Broadcast Drive, Kowloon, a 24 hour-a-day uninterrupted live feed of its World Service broadcasts in the English language, by satellite via Hong Kong Telecom International Ltd. (or any other suitable company), or by any other instantaneous means of transmission the technical quality of which is not inferior to that of satellite transmission, without any charge or expense to RTHK, in consideration for which RTHK will maintain at less than the present level, namely 24 hours-a-day, the live relay-broadcasts of this World Service; and
