Your letter of 29 August to Michael Stone refers.
Our legal advisers have looked at the matters raised in Mr Water's letter of 19 June. They have commented that as Section 38 (2) of the Superannuation Act 1965 enables rules on superannuation benefits to be payable in respect of persons who have been employed in more than one public office (and section 39 is a definitions section), they are not clear why it is relevant to Hong Kong and needs to be localised. It seems that Rule 2.29 is not dealing with people who have been employed in more than one public office.

However, as this matter has been allowed to lapse since our reply in 1987, we will need to know more of the background before we can reply further. I would be grateful if you could send us any relevant papers on this from 1986 and earlier. I have also written to the ODA to ask for their comments on Mr Water's letter and to see if they can fill in some more of the background.
I would be grateful if you could send the information to Miss Emma Williams who is taking over from me in HKD.
