To alter the method of calculation of additional pension

for injury by relating it directly to % of incapacity.

For civil servants with less than five years service and

who are required to retire as a result of duty related injuries received, the service pension can be enhanced by enhancing the number of years of pensionable service, subject to a minimum of two years and a maximum not exceeding the period of service which the officer would have

completed on attaing normal retirement age. The sum total

of additional pension and service pension he may receive

together should not exceed 5/6 of his maximum salary.

The British side state that additional expenses to be

incurred (if any) in implementing the above-mentioned

proposal will be negligible.

Proposed change to make pension increase a statutory

right.

The Pensions (Increase) Ordinance and the Widows and Orphans

Pension (Increase) Ordinance are to be amended to make cost of living inflation pension increases a statutory right and to specify the method of annual pension adjustments by reference to the movement of the consumer price Index A. The British side is of the opinion that this amendment will not incur additional expenditure.

III

Proposed technical amendments to the pensions legislation.

1. The pensions legislation is to be amended to count all service below the age of 18 years as pensionable service for pension computation. But this will still be subject to the restrictions that the maximum amount of pension for a civil servant should not exceed 2/3 of his maximum salary. The British side opine that additional expenses for this proposal is negligible.
