The Tenderer's attention is drawn to Clause 41(1)

of the GCC (Note 1) and to the provisions of the Immigration Ordinance Cap. 115, and in particular to the Immigration Amendment Ordinance of

of 1990 (Note 2). The Contractor shall be expected develop a plan to prevent illegal immigrants being employed on the Site or in relation to the Works by the Contractor directly or by a sub-contractor of any tier.

In this regard, the Tenderer is reminded that, as a general policy, the importation of labour from

outside Hong Kong is not allowed by the Immigration Department, save that in some special deserving circumstances, the Director of Immigration may permit the importation of key management and technical and other personnel on a temporary basis.

Government has announced that for the Airport Core Projects, of which Contract No. ( ) is one, the importation of labour may be permitted.
