INTRODUCTION

On 9 July 1991, the Council asked that a memorandum be submitted on 16 July giving the precise wording to be used in the tender documents to be issued for the Lantau Fixed Crossing and if appropriate, other airport-related projects, on the subject of importing labour. Relevant previous Council memoranda should be attached. The memorandum should also address concerns expressed regarding the invitation to tenderers to indicate in the tender document their likely requirement for imported labour on a year-by-year basis.

This memorandum sets out the relevant draft clauses under the Tsing Ma Bridge Tender Documents and outlines the proposed importation of labour scheme for airport-related projects. It also addresses concerns expressed on how suitable assurances should be given to tenderers in a politically acceptable manner.

On 29 May 1990, having considered memorandum XCC(90)74 (copy at Annex A), the Council advised and the Governor ordered, inter alia, that a separate scheme for the importation initially of 2 000 construction workers should be established, to facilitate the new airport and airport- related projects.

Need for the Scheme

Latest estimates on the volume of construction works in both the public and private sectors during 1992-1996, the main construction period of the new airport and related projects, indicate that the local construction labour market is unlikely to be able to provide all the workers required. It is expected that wages will continue to increase and will remain as a major cost component in construction works. In order to enable the new airport and related projects to be completed in the given time span and within a tight budget, labour importation under a scheme specifically designed for these projects is required. By ensuring that an adequate supply of labour would be available for the successful tenderers, contractors who bid
