4. I ASKED ABOUT THE SIGNIFICANCE OF A NEW BODY SET UP UNDER THE STATE COUNCIL TO OVERSEE IPRS, WHICH WAS ANNOUNCED ON 24 OCTOBER. ROY SAID THAT HITHERTO IPR QUESTIONS FELL TO MOFERT TO DEAL WITH, BUT MOFERT LACKED THE CLOUT TO GET MINISTRIES WITH, E.G. INTERESTS IN MAKING MAXIMUM USE OF PIRATED US SOFTWARE, TO DO WHAT IT WANTED. THE NEW STATE COUNCIL BODY WOULD HAVE GREATER AUTHORITY. IT WOULD BE A USEFUL MECHANISM FOR THE CHINESE TO USE IF THEY WERE SERIOUS.
SUPER 301.
5. THE SUPER 301 INVESTIGATION, WHICH HAD BEEN ANNOUNCED ON 10 OCTOBER, INTO MARKET ACCESS WAS CONCENTRATING ON FOUR AREAS:
(A) TRANSPARENCY OF TRADE REGULATIONS.
(B) IMPORT RESTRICTIONS.
(C) IMPORT BANS.
(D) UNREASONABLE REGULATIONS ON SPECIFICATIONS OF IMPORTS.
THE TALKS WERE THE FOURTH ON THE SUBJECT (BUT THE FIRST SINCE THE ANNOUNCEMENT OF THE SUPER 301 INVESTIGATION). THEY HAD BEEN CONSTRUCTIVE AND HAD MADE PROGRESS. THE CHINESE WERE AWARE OF THE CLOSE LINKS WITH GATT COMPATIBILITY AND WERE MAKING EFFORTS TO MEET US CONCERNS. THEY HAD HOWEVER SAID THAT THEY NEEDED TIME, AND ALSO THAT CERTAIN TARIFF CUTTING EXERCISES WERE BEST CARRIED OUT IN ACCORDANCE WITH GATT RULES AFTER CHINA HAD REJOINED.
TELECOMMUNICATIONS/UNPUBLISHED TRADE REGULATIONS.

THE US HAD OBTAINED A LARGE NUMBER OF INTERNAL DOCUMENTS REVEALING UNPUBLISHED TRADE REGULATIONS. IN PARTICULAR STATE COUNCIL DOCUMENT NO 56 DEALT WITH TELECOMMUNICATIONS AND MADE IT CLEAR THERE WERE BLATANTLY RESTRICTIVE ANTI-U S RULES, AND THAT PROVINCIAL GOVERNMENTS HAD NO RIGHT TO DECIDE TELECOMMUNICATIONS PROJECTS.
SOFT LOANS.

MASSEY SAID THE US WAS OPPOSED TO THE GRANTING OF SOFT LOANS TO CHINA AND WOULD BE RAISING THE MATTER WITH HER OTHER TRADING PARTNERS.
