CR92 requires the Secretary of State's approval for the retirement of an officer on medical grounds, if the officer

icer was selected for appointment by the Secretary of State. This will continue to apply and be dealt with at

departmental level.

Chairmanship of the Public Service Commission (PSC)

Since the establishment of the Commission in 1950, the Secretary of State's approval has been sought for the appointment of its Chairman. Hong Kong Government have been unable to trace the rationale for this although as the Chairman of the PSCs of Secretary rank, it is likely that the arrangement may have paralleled that in respect of Civil service officers at grade D3 and above. The Chairman of the

PSC however is not a member of the Public Service and it is

arguable whether this arrangement should ever have applied. I recommend, in accordance with the wishes of the Hong Kong Government, that the future appointment and dismissal of the Chairman is dealt with without referral to the Secretary of
